Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the ScreenCraft desktop application and the screencraft-recorder.vercel.app website (the "Service") operated by MSA Creatives ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Open Source License

The ScreenCraft desktop application is open-source software licensed under the MIT License. You are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, subject to the conditions of the MIT License. A copy of the MIT License is included with the software distribution.

2. Use of the Application

You agree to use ScreenCraft only for lawful purposes. You are solely responsible for the content you capture, record, and distribute using our software. We do not monitor, store, or have access to any content you create. You must ensure you have the legal right to record and distribute the material you capture, including respecting copyright laws and the privacy rights of others.

3. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

4. Intellectual Property

While the software code is licensed under the MIT License, the ScreenCraft name, logo, branding, and website design are the intellectual property of MSA Creatives and may not be used without explicit permission, except as permitted by fair use principles.

5. Limitation of Liability

In no event shall MSA Creatives, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

6. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
